Purposes and legal basis of the processing (Art. 13(1)(c) GDPR)

The personal data you provide will be used for the following purposes, each with its corresponding legal basis:

  • Customer management and order processing: necessary for the performance of a contract to which you are a party (Art. 6(1)(b) GDPR).
  • Sending newsletters and commercial communications: based on your consent (Art. 6(1)(a) GDPR).
  • Invoicing and accounting obligations: to comply with a legal obligation (Art. 6(1)(c) GDPR).
  • Technical logs during device repairs: based on our legitimate interest in providing a good service (Art. 6(1)(f) GDPR). The legitimate interest relates to the correct technical handling and follow-up of repairs.

Recipients of personal data (Art. 13(1)(e) GDPR)

Your personal data will not be sold, rented out or passed on to third parties for commercial purposes. However, in order to provide our services, your data will be processed by the following categories of recipients:

Google LLC (Google Analytics): for website analysis. Google acts as a processor in this regard. See below for further details.

Transfer to third countries (Art. 13(1)(f) GDPR)

Via Google Analytics, data (including your IP address) is transferred to servers of Google LLC in the United States. Google LLC is certified under the EU-US Data Privacy Framework, which recognised by the European Commission as providing an adequate level of protection (Adequacy Decision of 10 July 2023).

Retention periods (Art. 13(2)(a) GDPR)

Personal data will not be kept for longer than is necessary for the purpose for which it was collected:

  • Customer and order data: retention period in accordance with the statutory accounting retention obligation of 10 years, after which it is deleted or anonymised.
  • Google Analytics data: up to 26 months.
  • Other data: retained for as long as necessary for the specified purpose, after which it is deleted or anonymised.

Your rights as a data subject (Art. 13(2)(b), (c) and (d) GDPR)

You have the following legal rights regarding your personal data:

Obligation to provide data (Art. 13(2)(e) GDPR) 

The provision of certain personal data is a contractual requirement or a requirement necessary to enter into a contract. If you refuse to provide the requested data, MLS nv will be unable to perform the contract (e.g. delivery of an order is not possible without a name and delivery address). Data requested solely for optional services (e.g. newsletter) is not mandatory. 

Security of your personal data 

MLS nv takes appropriate technical and organisational measures to protect your personal data against loss, misuse or unauthorised access. The infrastructure is constantly kept up to date and adapted in accordance with best practice principles. Employees are trained and kept informed about the handling and risks associated with personal data. Your password is stored in encrypted form; MLS nv has no access to it. You are responsible for keeping your login details confidential. 

The use of ‘cookies’ 

When you visit the site, “cookies” may be placed on your computer's hard drive. A cookie is a text file that is placed by a website's server in your computer's browser or on your mobile device when you visit a website. Cookies cannot be used to identify individuals; a cookie can only identify a device.

GDPR Policy

  • Purpose limitation: data is collected only for specific, explicitly defined and legitimate purposes, and is not further processed in a manner incompatible with those purposes.

  • Accuracy: MLS nv takes reasonable measures to ensure that personal data is accurate and up to date. 
  • Storage limitation: personal data is not retained for longer than is necessary for the purpose for which it was collected. Thereafter, it is deleted or anonymised. 
  • Integrity and confidentiality: MLS nv takes appropriate technical and organisational measures to protect personal data, including encryption, access restrictions and regular evaluation of security measures.
